Section 1. Short title

This Act may be cited as the Protecting Children Over Profits Act.

Section 2. Amendments

Title 18 of the United States Code is amended—

(1) in section 2706(c)—

(A) by striking The requirement and inserting the following:

(1) Telephone records

The requirement

(A) ; and

(B) by adding at the end the following:

(2) Child exploitation

The requirement of subsection (a) of this section does not apply with respect to records or other information maintained by a provider of electronic communications service, or remote computing service that relate to child exploitation, as defined in section 2 of the PROTECT Our Children Act of 2008 (34 U.S.C. 21101).

(2) in section 2518, in the matter following subsection (4)(e), in the penultimate sentence, by inserting, except that no provider of electronic communications service or remote computing service, as defined in section 2711, shall be compensated by the applicant for expenses incurred with respect to information, facilities, or technical assistance relating to child exploitation, as defined in section 2 of the PROTECT Our Children Act of 2008 (34 U.S.C. 21101) after such facilities or assistance; and

(3) in section 3124(c), by inserting, except that no provider of electronic communications service or remote computing service, as defined in section 2711, shall be compensated for expenses incurred with respect to facilities or technical assistance relating to child exploitation, as defined in section 2 of the PROTECT Our Children Act of 2008 (34 U.S.C. 21101) before the period at the end.
