No Pensions for Congressional Predators Act

Section 1. Short title

This Act may be cited as the No Pensions for Congressional Predators Act.

(a) Civil Service Retirement System

Section 8332(o)(2) of title 5, United States Code, is amended—

(1) in subparagraph (A)—

(A) in clause (ii), by striking the period at the end and inserting, except that such requirement shall not apply with respect to an offense described in clause (xxxii), (xxxiii), (xxxiv), or (xxxv) of subparagraph (B).; and

(B) in clause (iii)—

(i) in subclause (I)(bb), by striking; or and inserting a semicolon;

(ii) in subclause (II)(bb), by striking the period at the end and inserting; or; and

(iii) by adding at the end the following:; and

(III) is committed after the date of enactment of the No Pensions for Congressional Predators Act and is described in clause (xxxii), (xxxiii), (xxxiv), or (xxxv) of subparagraph (B).

(2) in subparagraph (B), by adding at the end the following:

(xxxii) If the individual is or was a member of the Senate or the House of Representatives, a Delegate to the House of Representatives, or the Resident Commissioner from Puerto Rico, an offense under chapter 109A of title 18 (relating to sexual abuse) or any similar offense under State or Tribal law, including rape.

(xxxiii) If the individual is or was a member of the Senate or the House of Representatives, a Delegate to the House of Representatives, or the Resident Commissioner from Puerto Rico, an offense under chapter 110 of title 18 (relating to sexual exploitation and other abuse of children) or any similar offense under State or Tribal law.

(xxxiv) If the individual is or was a member of the Senate or the House of Representatives, a Delegate to the House of Representatives, or the Resident Commissioner from Puerto Rico, an offense under section 1466A of title 18 (relating to obscene visual representations of the sexual abuse of children) or any similar offense under State or Tribal law.

(xxxv) If the individual is or was a member of the Senate or the House of Representatives, a Delegate to the House of Representatives, or the Resident Commissioner from Puerto Rico, an offense under chapter 117 or section 1590 or 1591 of title 18 (relating to trafficking of children and other persons) or any similar offense under State or Tribal law.

(b) Federal Employees' Retirement System

Section 8411(l)(2)(C) of title 5, United States Code, is amended by striking the period at the end and inserting the following:, or, in the case of an offense described in any of clauses (xxxii) through (xxxv) of section 8332(o)(2)(B), after the date of enactment of the No Pensions for Congressional Predators Act..

(c) Application

For purposes of applying section 8332(o) or 8411(l) of title 5, United States Code, the amendments made by this section shall apply to any act or omission occurring after the date of enactment of this Act.
