Section 1. Short title
This Act may be cited as the ICE Protection Act of 2026.
Section 2. Protection of ICE agents from vehicles
Section 111 of title 18, United States Code, is amended by striking subsection (b) and inserting the following:
(1) In general
Subject to paragraph (2), whoever, in the commission of an act described in subsection (a), uses a deadly or dangerous weapon (including a weapon that is intended to cause death or danger but fails to do so by reason of a defective component) or inflicts bodily injury, shall be fined under this title or imprisoned not more than 40 years, or both.
(2) Use of motor vehicle
If the deadly or dangerous weapon (including a weapon that is intended to cause death or danger but fails to do so by reason of a defective component) used to commit an act described in subsection (a) is a motor vehicle, and the act results in—
(A) bodily injury (as defined in section 1365), the defendant shall be imprisoned not less than 5 years;
(B) substantial bodily injury (as defined in section 113), the defendant shall be imprisoned not less than 7 years; or
(C) serious bodily injury (as defined in section 1365), the defendant shall be imprisoned not less than 10 years.
