Section 1. Short title
This Act may be cited as the Rural Safety Administration Flexibility Act.
Section 2. Highway safety programs
Section 402(b) of title 23, United States Code, is amended—
(1) in paragraph (1)(C), by inserting (or, in the case of a rural State, 20 percent) after 40 percent; and
(2) by adding at the end the following:

In this subsection, the term rural State means any State, the population density of which is below the national average (as determined based on data from the most recent decennial Census).
