Childhood Disability Benefits Fairness Act

Section 1634(c) of the Social Security Act (42 U.S.C. 1383c(c)) is amended to read as follows:

(c) Any individual entitled to child’s insurance benefits which are payable under section 202(d) shall be treated for purposes of title XIX as receiving benefits under this title so long as such individual would be eligible for benefits under this title in the absence of such child’s insurance benefits.

The amendment made by this section shall apply with respect to any determination or redetermination of eligibility for medical assistance under a State plan (or a waiver of such plan) under title XIX of the Social Security Act (42 U.S.C. 1396 et seq.) made on or after the date of the enactment of this section.
