Section 1. Short title
This Act may be cited as the Keep Food Containers Safe from PFAS Act of 2026.
(a) In general
Section 301 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 331) is amended by adding at the end the following:
(1) The introduction or delivery for introduction into interstate commerce of food packaging containing intentionally added PFAS.
(2) In this paragraph, the term PFAS means a class of fluorinated organic chemicals containing at least one fully fluorinated methyl or methylene carbon atom.
(b) Applicability
The amendment made by subsection (a) applies beginning on January 1, 2027.
