Section 1. Short title
This Act may be cited as the HCBS Anti-Fraud Reporting Act of 2026.
Section 2. Requiring States to report on anti-fraud measures relating to home and community-based services furnished under the Medicaid program
Section 1915(c)(2) of the Social Security Act (42 U.S.C. 1396n(c)(2)) is amended—
(1) in subparagraph (D), by striking and at the end;
(2) in subparagraph (E), by striking the period and inserting; and; and
(3) by adding at the end the following new subparagraph:
(F) with respect to 2026 and each subsequent year, the State will report to the Secretary on—
(i) any waste, fraud, or abuse detected by the State relating to services furnished under such waiver; and
(ii) efforts taken by the State to prevent such waste, fraud, and abuse.
