Section 1. Short title
This Act may be cited as the State Emissions Authority Act of 2026.
Section 2. Repeal of mandatory State motor vehicle inspection and maintenance requirements
The Clean Air Act (42 U.S.C. 7401 et seq.) is amended—
(1) in section 118 (42 U.S.C. 7418), by striking subsections (c) and (d); BMGautam: government vehicles and federal installations required to comply w/ I&M programs
(2) in section 182 (42 U.S.C. 7511a)—
(A) in subsection (a)(2), by striking subparagraph (B) and redesignating subparagraph (C) as new subparagraph (B); BMGautam: Requirement for States to submit SIP revisions with I&M program updates
(B) in subsection (b)—
(i) by striking paragraph (1)(D)(iv); and BMGautam: Limit on creditability of reductions for measures required under (a)(2)(B)- struck above
(ii) by striking paragraph (4) and redesignating paragraph (5) as new paragraph (4); BMGautam: Requirement for States to submit SIP revisions with I&M program updates
(C) in subsection (c)—
(i) in the matter preceding paragraph (1), by striking Except as otherwise specified in paragraph (4) and inserting Except as otherwise specified in paragraph (3); and
(ii) by striking paragraph (3) and redesignating paragraphs (4) through (10) as new paragraphs (3) through (9), respectively; and BMGautam: Requirement for State enhanced vehicle inspection and maintenance program
(D) in subsection (e), by striking paragaphs (6), (7) and (8) and inserting paragraphs (5), (6), and (7);
(3) in section 184(b)(1) (42 U.S.C. 7511c(b)(1)), by striking the following and all that follows through implementation and inserting implementation; and BMGautam: requires States to submit SIPs requiring compliance with enhanced vehicle and inspection maintenance programs
(4) in section 187(a) (42 U.S.C. 7512a(a))—
(A) by striking paragraph (4); BMGautam: Savings clause, refers back to 182(a)(2)(B)
(B) by striking paragraph (6); and BMGautam: enhanced vehicle inspection and maintenance, refers back to 182(c)(3)
(C) by redesignating paragraphs (5) and (7) as new paragraphs (4) and (5), respectively.
