Snap Delivery Modernization Act of 2025

(1) in section 3 by adding the following definition—.

(X) Delivery platform or delivery services provider means an entity that—

(1) facilitates the online-sale, or delivery, or both, of food from a retail food store; or

(2) delivers food purchased from a retail food store, including using a first-party delivery service or contracting with a third-party to complete delivery.

(2) in section 3(o)(5)—

(A) in subparagraph (B)—

(i) by striking order— and all that follows through (i), and

(ii) by striking clause (ii), and

(B) in subparagraph (C) by inserting (excluding related fees for delivery of the food) before the period at the end, and

(3) in section 7(k)—

(A) in subparagraph (2)(B)—

(i) by striking delivery,, and

(ii) by inserting (excluding delivery fees charged by the retail food store or a delivery platform or delivery service) after charges, and

(B) in subparagraph (C)(i)—

(i) by striking delivery,, and

(ii) by inserting (excluding delivery fees charged by a retail food store, or a delivery platform or delivery service) after purchase.
