Section 1. Prohibiting use of appropriated funds to make Medicare Advantage the default under the Medicare program

Notwithstanding any other provision of law, none of the funds made available by previous Appropriations Acts to the Department of Health and Human Services for obligation or expenditure in the current fiscal year may be used for any activity that deems an individual entitled to benefits under part A and enrolled under part B of title XVIII of the Social Security Act (42 U.S.C. 1395 et seq.) who fails to make an election under subsection (e)(1) of section 1851 of such title to have elected an MA plan under part C of such title other than as provided in subsection (c)(3) of such section.
