Section 1. Short title
This Act may be cited as the Innovative Nutrition for Seniors Act.
(a) In general
Part C of title III of the Older Americans Act of 1965 (42 U.S.C. 3030d–21 et seq.) is amended—
(1) by redesignating subpart 3 as subpart 4; and
(2) by inserting after subpart 2 the following:
(a) In general
Notwithstanding any other provision in this Act, a State with a State plan approved under section 307 may use not more than 5 percent of the amounts received by the State that are attributable to funds appropriated under paragraph (1) of section 303(b) for the establishment and operation of innovative nutrition services that—
(1) improve the reach of the nutrition services provided under subparts 1 and 2; and
(2) address food insecurity among older individuals or improve the health and well-being outcomes for older individuals.
(b) Services
Services under this section may include—
(1) providing carry-out meals, grab-and-go meals, mobile food units, or medically-tailored meals;
(2) providing medical nutrition therapy in consultation with a dietitian or other qualified individual described in section 339(1) for the prevention, management, or treatment of a disease; or
(3) carrying out any other nutrition activities approved by the State agency.
(c) Nutrition requirements
In the case of any services supported under this section that provide meals to older individuals, such meals shall comply with the requirements for nutrition projects under section 339.
(1) In general
Section 205(a)(2)(A) of the Older Americans Act of 1965 (42 U.S.C. 3016(a)(2)(A)) is amended—
(A) in the matter preceding clause (i), by striking subparts 1 and 2 of part C of title III and inserting subparts 1, 2, and 3 of part C of title III; and
(B) in clause (ix), by striking subparts 1 and 2 of part C of title III and inserting subparts 1, 2, and 3 of part C of title III.
(2) Reporting
Section 308(b)(7)(C) of the Older Americans Act of 1965 (42 U.S.C. 3028(b)(7)(C)) is amended—
(A) in clause (i), by striking; and and inserting a semicolon; and
(B) by adding at the end the following:
(iii) subpart 3 of part C; and
(c) Native Americans
Title VI of the Older Americans Act of 1965 (42 U.S.C. 3057 et seq.) is amended—
(1) by resdesignating part E (42 U.S.C. 3057l et seq.) as part F; and
(2) by inserting after part D (42 U.S.C. 3057k–21 et seq.) the following:
(a) In general
Notwithstanding any other provision in this Act, a tribal organization receiving a grant under part A, or a public or private nonprofit private organization receiving a grant under part B, may use not more than 2 percent of the amount awarded to the organization through such grant to establish and operate, or contract with a service provider to establish and operate, innovative nutrition services that—
(1) improve the reach of—
(A) in the case of a grant to such a tribal organization, the nutrition services provided under part A; and
(B) in the case of a grant to such a nonprofit organization, the nutrition services provided under part B; and
(2) address food insecurity among, or improve the health and well-being outcomes, for—
(A) in the case of a grant to such a tribal organization, older individuals who are Indians; and
(B) in the case of a grant to such a nonprofit organization, older individuals who are Native Hawaiians.
(b) Services
Services under this section may include—
(1) providing carry-out meals, grab-and-go meals, mobile food units, or medically-tailored meals;
(2) providing medical nutrition therapy in consultation with a qualified dietitian or other individual described in section 339(1) for the prevention, management, or treatment of a disease; or
(3) carrying out any other nutrition activities approved by the applicable tribal organization or nonprofit organization receiving the grant.
(c) Nutrition requirements
In the case of any services supported under this section that provide meals, such meals shall comply with the requirements for nutrition projects under section 339.
