Section 1. Short title
This Act may be cited as the Workforce Data Access Transparency and Accountability Act or the Workforce DATA Act.
Section 2. Performance reports
Section 116(d)(1) of the Workforce Innovation and Opportunity Act (29 U.S.C. 3141(d)(1)) is amended—
(1) by striking Not later and inserting the following:; and
(A) Templates
Not later
(2) by adding at the end the following:
(B) Data collection entity
The entity listed as the recommended data collection entity in Attachment II of the Training and Employment Guidance Letter WIOA No. 3–18, entitled Eligible Training Provider (ETP) Reporting Guidance under the Workforce Innovation and Opportunity Act (WIOA), issued by the Employment and Training Administration on August 31, 2018, shall conduct data collection for reports under paragraphs (2), (3), and (4).
(i) Unemployment compensation data
A State that receives an allotment under this subtitle shall facilitate access for local boards in the State to unemployment compensation data, at the individual level, for participants in training services, to enable the local boards to meet the requirements of this section and section 122.
(ii) Wage data
A State that receives an allotment under this subtitle shall facilitate access for providers of training services in the State to wage data for participants in training services, to enable the providers to meet the requirements of this section and section 122.
(iii) Privacy
In facilitating access under this subparagraph, a State shall not reduce any protections required of or afforded by the State concerning the privacy of information on the individuals covered by the data involved.
