RESOLUTION

Censuring Representative Elise Stefanik of the 21st Congressional District of New York.

Whereas Representative Elise Stefanik has supported the duly charged and convicted January 6 insurrectionists, who attacked the United States Capitol, threatened violence against Members of Congress, and attempted to stop the certification of the 2020 Presidential election; Whereas, on January 7, 2024, Representative Stefanik stood by comments she made on the House Floor in the wake of the January 6 attack on the Capitol, including that "violence in any form is absolutely unacceptable, it is anti-American and must be prosecuted to the fullest extent of the law"; Whereas, on January 7, 2024, Representative Stefanik supported January 6 insurrectionists despite the fact that over 1,200 of them have been charged with breaking the law during the violent attack on the Capitol; Whereas, on January 7, 2024, Representative Stefanik referred to January 6 insurrectionists, many of whom are convicted criminals, as "hostages"; Whereas, on January 7, 2024, Representative Stefanik supported January 6 insurrectionists by refusing to commit to faithfully executing her constitutional duty to certify the 2024 election; Whereas even though hundreds of January 6 insurrectionists have pled guilty or been convicted by a jury of serious Federal crimes, including seditious conspiracy, on January 7, 2024, Representative Stefanik referred to the prosecution of January 6 insurrectionists as "the weaponization of the Federal Government . . . against conservatives"; Whereas, on December 15, 2023, Representative Stefanik improperly filed a bogus and vindictive ethics complaint against a Federal judge, who has overseen various criminal cases involving January 6 insurrectionists, alleging judicial misconduct based on accurate remarks that "big lies" surrounding the 2020 election led to criminal conduct on January 6 and the convictions of hundreds of individuals; Whereas, on December 15, 2023, instead of condemning the mass assault of over 140 police officers during the violent attack on the Capitol, Representative Stefanik posted on X that the same Federal judge's critique of violent January 6 insurrectionists is "illegal"; Whereas, on December 5, 2023, Representative Stefanik falsely referred to the independent Special Counsel Jack Smith's indictment of former President Trump, based on former President Trump's alleged criminal conduct related to his efforts to unlawfully overturn an election and disrupt the peaceful transfer of power on January 6, as "attempts to criminalize the First Amendment"; Whereas, on August 1, 2023, Representative Stefanik falsely referred to Special Counsel Smith's indictment of former President Donald Trump, based on former President Trump's alleged criminal conduct related to his efforts to unlawfully overturn an election, as efforts by President Biden to "suppress the will of the voters" and "meddle with the election using the Department of Justice"; Whereas, on June 10, 2022, Representative Stefanik supported January 6 insurrectionists by referring to the Select Committee to Investigate the January 6th Attack on the United States Capitol of the House of Representatives, which multiple courts determined to be a duly constituted congressional committee tasked with investigating the January 6 insurrection on the United States Capitol and Members of Congress, as a "witch hunt"; Whereas, on September 15, 2021, days before a widely reported rally in Washington, DC, supporting the charged January 6 insurrectionists, Representative Stefanik falsely claimed on Facebook that President Biden and fellow Democrats were seeking a "permanent election insurrection" by expanding pathways to citizenship for undocumented immigrants; Whereas, on January 6, 2021, Representative Stefanik peddled a debunked voter fraud conspiracy, stating that "more than 140,000 votes came from underage, deceased, and otherwise unauthorized voters in Fulton County alone", a claim Georgia's Republican Secretary of State's office called "ludicrous"; and Whereas Representative Stefanik promoted election lies leading up to the January 6 insurrection, including in an interview dated December 1, 2020, stating "concerns" about the debunked and baseless Dominion Voting Systems conspiracy theory, which helped incite the attack on the Capitol: Now, therefore, be it Resolved, That-- (1) the House of Representatives censures Elise Stefanik, Representative from the 21st Congressional District of New York; (2) Representative Elise Stefanik will forthwith present herself in the well of the House of Representatives for the pronouncement of censure; and (3) Representative Elise Stefanik will be censured with the public reading of this resolution by the Speaker.
