Section 1. Short title
This Act may be cited as the Maximize Risk-Informed, Performance-Based Licensing Act.
(a) Definition of technology-Inclusive regulatory framework
Section 3(14) of the Nuclear Energy Innovation and Modernization Act (42 U.S.C. 2215 note)—
(1) by striking where appropriate and inserting to the maximum extent practicable; and
(2) by inserting that are consistent with the expectations, concepts, and definitions in the Staff Requirements Memorandum from the Secretary of the Commission to the Executive Director for Operations dated March 1, 1999, regarding ‘Staff Requirements - SECY–98–144 - White Paper on Risk-Informed and Performance-Based Regulation’ (hereinafter referred to as SRM–SECY–98–144) after risk-informed and performance-based techniques.
(b) Annual training
Section 103(a)(2) of the Nuclear Energy Innovation and Modernization Act (42 U.S.C. 2133 note) is amended by inserting, including annual training on the expectations, concepts, and definitions in SRM–SECY–98–144, after strategies.
(c) Sense of Congress
It is the sense of Congress that it is important that the Nuclear Regulatory Commission and the regulated community have a common understanding of how risk-informed and performance-based techniques are applied to Nuclear Regulatory Commission rulemaking, licensing, inspection, assessment, enforcement, and other decision-making processes.
