Section 1. Short title

This Act may be cited as the No Toxic Chemicals in Cosmetics Act.

(a) Sunscreen containing parabens

Section 501 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 351) is amended by inserting after paragraph (j) the following:

(k) If it is a drug that—

(1) contains 1 or more active ingredients intended for application to the skin of humans for purposes of absorbing, reflecting, or scattering ultraviolet radiation; and

(2) bears or contains parabens, including esters of parahydroxybenzoic acid, which include methylparaben, ethylparaben, propylparaben, butylparaben, isopropylparaben, isobutylparaben, benzylparaben, phenylparaben, and pentylparaben.

(b) Cosmetics containing parabens

Section 601 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 361) is amended by adding at the end the following:

(h) If it bears or contains parabens, including esters of parahydroxybenzoic acid, which include methylparaben, ethylparaben, propylparaben, butylparaben, isopropylparaben, isobutylparaben, benzylparaben, phenylparaben, and pentylparaben.

(c) Applicability

The amendments made by subsections (a) and (b) shall apply only with respect to drugs and cosmetics introduced or delivered for introduction into interstate commerce on or after the date that is 2 years after the date of the enactment of this Act.
