To direct the Secretary of Defense to periodically publish a report with respect to any human toxic exposures in Guam during the period beginning on August 15, 1958, and ending on July 31, 1980, and for other purposes.

Not later than 1 year after the date of the enactment of this section, and not less frequently than every 3 years thereafter, the Secretary of Defense, in coordination with the Secretary of Health and Human Services and the Director of the Agency for Toxic Substances and Disease Registry, shall publish in the Federal Register and on the website of the Department of Health and Human Services a report that includes following:

(1) A review of scientific literature with respect to any relationship between individuals present in Guam for more than 30 days during the period beginning on August 15, 1958, and ending on July 31, 1980, and any particular illnesses or conditions incurred by such individuals. Such review shall include bibliographic citations of such literature.

(2) A determination with respect to any evidence that exposure to a toxic substance during the period specified in paragraph (1) may be a cause of any such illness or condition, with such determination categorized as one of the following:

(A) Sufficient evidence to conclude with reasonable confidence that exposure to a toxic substance is a cause of the illness or condition.

(B) Modest evidence to support that exposure to a toxic substance is a cause of the illness or condition, but not sufficient to conclude with reasonable confidence that such exposure is a cause.

(C) Limited evidence to support that exposure to a toxic substance is a cause of the illness or condition.

(3) Any documentation with respect to the transfer and storage of Agent Orange in Guam during the period beginning on August 15, 1958, and ending on July 31, 1980.

In addition to the periodic reports required under subsection (a), the Secretary of Defense, in coordination with the Secretary of Health and Human Services and the Director of the Agency for Toxic Substances and Disease Registry, shall from time to time publish in the Federal Register and on the website of the Department of Health and Human Services updates to such most recently published report to reflect any subsequent determinations made under subsection (a)(2).

In this section, the term Agent Orange means an herbicide agent containing dioxin or 2,4-dichlorophenoxyacetic acid.
