Section 1. Short title

This Act may be cited as the American Worker Protection Act of 2024.

(a) In general

Section 214(g) of the Immigration and Nationality Act (8 U.S.C. 1184(g)) is amended by adding at the end the following:

(12) Aliens who are subject to the numerical limitations of paragraph (1)(A) shall be issued visas (or otherwise provided nonimmigrant status) in the order of the highest compensation rate included in the application for such visa to the lowest compensation rate.

(b) Rules

Prior to the issuance of a visa or nonimmigrant status under section 101(a)(15)(H)(i)(b) for the first fiscal year following the date of the enactment of this Act, the Secretary of Homeland Security shall issue any rules necessary to carry out section 214(g)(9) of the Immigration and Nationality Act (8 U.S.C. 1184(g)(9)), as amended by this Act.
