Section 1. Short title

This Act may be cited as the Honoring Our Nation’s Own Retired Servicemembers Act or the HONORS Act.

Section 2. Honors detail for the funeral of a veteran: required members may be retired

Section 1491(b) of title 10, United States Code, is amended—

(1) in paragraph (2), in the first sentence, by inserting, subject to paragraph (4) after other than members in a retired status; and

(2) by adding at the end the following new paragraph:

(4) The two members described in the first sentence of paragraph (2) may, with the consent of the family of the veteran, be members in a retired status if the Secretary concerned determines that—

(A) no member who is not in a retired status is available within 50 miles of the location of the funeral; or

(B) use of members in a retired status is fiscally necessary.
