Section 1. Short title
This Act may be cited as the Consumer Product Sanity Act.
Section 2. Increasing reliance by Commission on voluntary consumer product safety standards
Section 7(b) of the Consumer Product Safety Act (15 U.S.C. 2056(b)) is amended by adding at the end the following:
(3) In any case in which the Commission determines that compliance with a voluntary consumer product safety standard would eliminate or adequately reduce the risk of injury addressed, but determines substantial compliance with such voluntary standard is not likely, the Commission may promulgate a consumer product safety standard addressing such risk of injury only if—
(A) such consumer product safety standard is identical to such voluntary standard; or
(B) in the case of a consumer product safety standard that allows for compliance in more than one manner, at least one such manner of compliance is identical to such voluntary standard.
