Enhancing Hospice Oversight and Transparency Act

Section 1. Short title

This Act may be cited as the Enhancing Hospice Oversight and Transparency Act.

(a) Special focus program

Section 1822(b) of the Social Security Act (42 U.S.C. 1395i–6(b)) is amended—

(1) in paragraph (1), by inserting, beginning not earlier than the date specified in paragraph (3), after shall; and

(2) by adding at the end the following new paragraphs:

For purposes of paragraph (1), the date specified in this paragraph is—

(A) January 1, 2027, or

(B) the date on which a State or local survey agency, or an approved accreditation agency, has, during the most recent 36-month period specified in subsection (a), conducted at least 1 survey under such subsection with respect to each entity that is certified as a hospice program (as described in such subsection) as of the date of the enactment of the Enhancing Hospice Oversight and Transparency Act,

whichever is earlier.

(4) Feedback reports

On or after January 1, 2027, the Secretary may publicly identify a hospice program that is selected for such special focus program as being so selected if, not later than 60 days before such public identification, the Secretary provides a confidential feedback report to such hospice program that includes the Secretary’s rationale for such selection.

(b) Increasing payment reductions for failure To meet quality data reporting requirements

Section 1814(i)(5)(A)(i) of the Social Security Act (42 U.S.C. 1395f(i)(5)(A)(i)) is amended by striking by 2 percentage points (or, for fiscal year 2024 and each subsequent fiscal year, 4 percentage points). and inserting

by—

(I) for fiscal years 2014 through 2023, 2 percentage points;

(II) for fiscal years 2024 through 2026, 4 percentage points; and

(III) for fiscal year 2027 and each subsequent fiscal year, 10 percentage points.

Section 1814(i)(5)(E) of the Social Security Act (42 U.S.C. 1395f(i)(5)(E)) is amended by inserting the failure of a hospice program to submit such data under subparagraph (C) and after The Secretary shall report.
